PushBlocker — Exercise to Scroll
These Terms & Conditions (“Terms”) are a binding agreement between you and Arifur Rahman, an independent app developer (“we”, “us”), covering your use of the iOS application PushBlocker — Exercise to Scroll (“PushBlocker”, “the app”).
By downloading, opening or using PushBlocker you accept these Terms. If you do not accept them, do not use the app. Our handling of information is described separately in the Privacy Policy, which forms part of these Terms.
You must be at least 13 years old to use PushBlocker. If you are under the age of majority where you live, you may use it only with the involvement and consent of a parent or guardian, who accepts these Terms on your behalf. You must have the authority to configure restrictions on the device you install it on.
PushBlocker helps you limit your own use of apps and websites. It does this through Apple's Screen Time frameworks: you choose what to block and when, and iOS applies a shield over those apps. To unlock, the app can require you to complete physical exercise, which it counts using the camera.
You should understand the following before relying on it:
PushBlocker is not a medical device and provides no medical advice.
The exercises it prompts — push-ups, squats, planks, jumping jacks and similar movements — carry an inherent risk of injury. Consult a physician before beginning any exercise programme, particularly if you are pregnant, have a heart condition, joint or back problems, high blood pressure, a recent injury or surgery, or any other condition that physical exertion could aggravate. Stop immediately if you feel pain, dizziness, shortness of breath or discomfort.
You exercise entirely at your own risk. You are responsible for choosing a difficulty and a repetition goal appropriate to your fitness, for using correct form, and for exercising in a safe, clear space with stable footing and nothing within striking distance. Never attempt exercises while driving, cycling, standing on an unstable surface, near stairs or traffic, or anywhere a fall could injure you or others. Do not prop your device where it could fall. The feedback the app displays about your form is generated automatically and is not supervision by a qualified trainer.
At your instruction, PushBlocker can shield apps and websites, prevent its own deletion while a block is active, and prevent changes to the device date and time. These are settings you enable, and their whole purpose is to be difficult to reverse in a moment of weakness. You accept that turning them on may make it inconvenient to reach a blocked app or to remove the app until the session ends or an unlock is earned.
You can always end the arrangement by revoking Screen Time permission for PushBlocker in iOS Settings → Screen Time, which lifts all shields the app has applied. Where the app offers an emergency unlock, it is deliberately limited in how often it may be used.
PushBlocker is free to download and offers a paid tier, PushBlocker Plus, which removes the free tier's limits and unlocks the full feature set. Plus is offered as an auto-renewing monthly subscription, an auto-renewing yearly subscription, and a one-time lifetime purchase. Discounted promotional prices may be offered from time to time and apply only for as long as they are shown.
All purchases are made through the Apple App Store and are subject to Apple's terms as well as these. In particular:
Because Apple is the merchant of record, we cannot issue refunds. Refund requests are made to Apple at reportaproblem.apple.com and are decided at Apple's discretion under its own policies. Statutory withdrawal or cancellation rights you may have under consumer law in your country are unaffected by this paragraph.
We may add, change or withdraw features, and may change which features require Plus. Where a change materially reduces what an existing paid subscription provides, we will give reasonable notice through the app or the App Store listing. Price changes to an existing auto-renewing subscription take effect only in accordance with Apple's rules, which require notice and, in most cases, your consent before the new price is charged.
You agree not to: reverse engineer, decompile or disassemble the app except to the extent that applicable law expressly permits; circumvent or tamper with its purchase verification or licensing; use it to restrict another person's device without that person's knowledge and lawful authority; use it in violation of any law; or resell, sublicense or redistribute it.
PushBlocker is licensed, not sold. Subject to these Terms, you receive a personal, non-exclusive, non-transferable, revocable licence to use one copy on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. The app, its name, its artwork, its animations, its bundled machine-learning models and its source code remain our property or that of our licensors. No rights are granted except those stated here.
PushBlocker relies on Apple (App Store, StoreKit, Screen Time and related frameworks) and on Google Firebase Analytics. Their availability and behaviour are outside our control, and their own terms and privacy policies apply to what they do.
To the fullest extent permitted by law, PushBlocker is provided “as is” and “as available”, without warranty of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, timely, error-free, compatible with every device or iOS version, or that blocks will always apply exactly when intended. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost opportunities, or missed communications, arising out of or relating to your use of or inability to use PushBlocker — including any app or website that was blocked, any block that failed to apply, and any injury arising from exercise undertaken through the app, except to the extent such injury results from our gross negligence or wilful misconduct.
Our total aggregate liability for all claims relating to PushBlocker will not exceed the greater of (a) the amount you paid us for the app in the twelve months before the claim arose, or (b) USD 50. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold us harmless from any claim, loss or expense (including reasonable legal fees) arising from your misuse of the app, your breach of these Terms, or your violation of any law or third-party right.
You may end this agreement at any time by deleting the app. We may suspend or terminate your licence if you materially breach these Terms. Sections 10, 12, 13, 14, 16 and 17 survive termination.
We may revise these Terms. The current version always appears at this address with its “Last updated” date, and material changes will be signalled in the app or in the App Store release notes. Continuing to use PushBlocker after a revision means you accept it. If you do not accept it, stop using the app and cancel any subscription.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in California will have jurisdiction over disputes — except that if you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer protections and the right to bring proceedings in the courts of your country of residence, where local law grants it.
The following apply because PushBlocker is distributed through the App Store, and they prevail over anything inconsistent elsewhere in these Terms:
If any provision is held unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between us regarding PushBlocker. You may not assign them; we may assign them in connection with a transfer of the app.
